Liability Release Agreement
Welcome to Marvalena: Your Coastal Retreat! Our goal is to provide comfortable accommodations and exceptional service for an unforgettable experience. As a condition of your property rental and as required by Vacation Rental insurance company, you must read and accept this Liability Release Agreement.
Property Rules:
1. No Pets Allowed:
- Pets of any kind are prohibited. If any pets are reported or found in any of our properties, a $500.00 cleaning fee will be charged to address possible pet hair and dander allergy issues for future guests.
2. No Smoking:
- Smoking of any kind, including tobacco, marijuana, or any other substances, is strictly prohibited anywhere on the Marvalena property. Violation of this rule will result in a charge of up to $1000.00 for smoke removal treatments.
- Note: Carpinteria is a clean air and smoke-free city.
3. No Unauthorized Events:
- No social receptions are allowed without written permission from the property manager.
4. No Extra Guests:
- Please do not exceed the maximum occupancy zoning laws and the allowed guests per booking. Any extra guests, including children and infants, will be evicted immediately or charged a flat fee for continued rental at the discretion of the Marvalena property.
5. Quiet Hours:
- Quiet hours are from 10:00 p.m. to 9:00 a.m. to ensure a peaceful environment for all guests.
6. Check-In and Check-Out:
- Check-in time: 2:00 p.m.
- Check-out time: 11:00 a.m.
Legal and Financial Terms:
- California Penal Code Section 537:
It is a crime to defraud an Innkeeper.
- Transaction Disputes:
If a transaction charge is disputed due to non-recognition or recall by the renter, a collection processing fee of $250.00 will be charged in addition to the original charges due on the transaction.
Enforcement:
- All rules are strictly enforced to ensure an excellent stay for all our guests. A party is considered any guests present on the property in addition to the reserved number of guests. Any additional guests must be cleared with the property manager.
- The City or County Sheriff's Department will be notified immediately of any violations.

This Liability Release Agreement outlines the terms and conditions for renting Marvalena at 130 Ash Avenue, Unit 12, Carpinteria, CA, and highlights the financial and legal responsibilities of the renter. By submitting a booking request for the property, you agree to the following:

"I have read and accept the terms, conditions, and credit card charges as outlined in my Reservation Confirmation. I agree to the following:
- I accept this rental property for use as is and assume full financial and legal responsibility for my group during our stay.
- I agree to abide by all rental regulations and accept responsibility for any damages caused during my stay. I understand that any broken or damaged items will be replaced at full value and charged to my credit card.
- I understand that the seaside terrain and architecture of Marvalena present inherent risks, including but not limited to slip or fall injuries, flame or contact burns, and death. I voluntarily assume all risks and accept legal responsibility for any injury, loss, or death sustained by myself, my guests, or any other occupants during our stay.
- I release Marvalena's owners, employees, affiliates, agents, officers, directors, and manufacturers from all liability related to slip and fall injuries, death, property loss, or damage that may arise from renting or using the property. This includes all liability due to negligence on the part of the providers or any other party.
- I agree to defend and indemnify the providers for any losses or damages, including claims or lawsuits related to personal injury, death, property loss, or damage arising from the use of the property by myself, my guests, or any other occupants during our stay.
This agreement is governed by the laws of the State of California. If any part of this agreement is found to be unenforceable, the remaining provisions shall remain in full force and effect.
